Suspect in baby killing found in Mexico
A Milwaukee man charged in 2005 with killing his 2-month-old daughter by punching her in the stomach has been captured in Mexico, where he fled after being charged with homicide in connection with the baby's death three years ago.
Milwaukee police are working to extradite Salvador Ochoa, 33, back to Wisconsin, a department spokeswoman said this week.
Milwaukee police spokeswoman Anne E. Schwartz reported that Ochoa is in custody under a warrant that had been issued for second-degree reckless homicide in the December 2005 death of his daughter, Rubi Ochoa-Cervantes.
Schwartz did not have details available on when or how Ochoa was caught.
The girl died on Dec. 12, 2005, after being taken to Children's Hospital of Wisconsin where surgeons discovered she had a perforated bowel that had become necrotic. Portions of the baby's stomach, kidneys and uterus were also necrotic, according to a Milwaukee County medical examiner's report.
The child's mother told investigators at the time that Ochoa told her he had punched the girl in the stomach after she would not stop crying.
The report concluded the child's injuries were caused by blunt force abdominal trauma. Investigators found she was also treated at Children's Hospital in November of 2005 for a skull fracture a month after she was born.
A criminal complaint charging her father in the days following her death noted the child had also suffered a broken rib. If convicted, Ochoa faces up to 25 years in prison.
After fleeing, Ochoa was also charged in Milwaukee County in a second criminal case for sexual assault of a child, repeated acts, involving a girl who was 8 years old at the time.
According to a criminal complaint, the girl told authorities that her father would call her into his bedroom while he was watching pornographic films. She told police that he indecently touched her over her clothes in her genital area four times between July 2005 and December 2005.
She told police that she was afraid not to do what her father told her to do because he would hit the children in the stomach if they did not listen.
